Bazaar.in Intellectual Property Infringement and Takedown Policy
Rights complaints, interim action, Seller response, counter-notice and repeat infringement
1. Purpose and Marketplace Role
1.1Bazaar.in provides the Platform, including marketplace technology, administration, support, verification and related services. Bazaar.in is not treated as the product seller unless expressly identified as seller of record for a transaction.
1.2References to Bazaar.in, the Platform, we, us or our mean Bazaar.in.
1.3Bazaar.in respects intellectual property and maintains a notice, review, response and enforcement process. It does not adjudicate ownership with the force of a court and may require parties to obtain an order for unresolved complex disputes.
2. Rights and Prohibited Conduct
2.1This Policy covers trademarks, copyright, patents, registered designs, trade dress, publicity and other legally recognized rights. Sellers must not list counterfeit goods or use unauthorized content, marks or brand assets.
2.2Sellers must retain invoices, licences, authorization and supply-chain evidence.
3. Who May Complain and Required Notice
3.1A rights owner, authorized licensee, representative or authority may complain. The notice must identify the complainant, right, ownership/authority, specific listing or content, legal basis and good-faith declaration.
3.2Incomplete notices may be returned for clarification. Sensitive evidence will be handled according to law and the Privacy Policy.
4. Preliminary Review and Interim Measures
4.1Bazaar.in may assess facial validity, specificity, urgency, prior history and safety/counterfeit risk. It may preserve evidence, restrict a listing, warn the Seller, hold proportionate proceeds or take emergency action.
4.2Interim action is not a final determination and should be reviewed promptly.
5. Seller Notice and Response
5.1The Seller should receive the non-confidential basis and may provide authorization, invoices, product provenance, corrected content or other response within the stated period.
5.2Failure to respond may result in continued restriction. Credible response may result in restoration, continued review or referral to legal process.
6. Counter-Notification and Restoration
6.1A counter-notice must identify the removed material, explain the lawful basis and include accurate contact and good-faith declarations.
6.2Bazaar.in may restore content when the complainant withdraws, fails to pursue required legal action or evidence supports restoration, subject to law and safety.
7. Counterfeit, Safety and Buyer Protection
7.1Credible counterfeit or unsafe-product evidence may justify immediate suspension, inventory quarantine, VMS review, Buyer notification, refund/replacement, reserve, termination and lawful authority cooperation.
7.2Buyer remedies remain governed by the Buyer Terms, VMS process and mandatory law.
9. False or Abusive Notices
9.1Knowingly false, misleading or anti-competitive complaints and counter-notices are prohibited and may lead to restriction, cost recovery or legal action.
9.2Bazaar.in may require additional verification from complainants with repeated unsupported notices.
10. Records, Privacy, Liability and Indemnity
10.1Notices, evidence, decisions and communications are retained for the legal, dispute, fraud and audit period. Personal data is handled under the Privacy Policy.
10.2The responsible party indemnifies protected Bazaar.in entities for third-party claims caused by its infringement or knowing false notice, subject to fair defence procedures. Nothing excludes non-excludable liability.
11. Contact and Legal Process
11.1Complaints must be submitted through the published IP channel, which must be confirmed before publication. Bazaar.in may comply with court, regulator and law-enforcement orders.
11.2Where ownership or validity cannot be resolved administratively, the parties may be directed to an appropriate court or neutral dispute process.
