Bazaar.in Marketplace Terms of Use
Governing access to and use of the Bazaar.in marketplace ecosystem
1. Parties, Scope and Acceptance
1.1Bazaar.in provides the Platform, including marketplace technology, administration, support, verification and related services. Bazaar.in is not treated as the product seller unless expressly identified as seller of record for a transaction.
1.2References to Bazaar.in, the Platform, we, us or our mean Bazaar.in.
1.3These Terms apply to the website, applications, buyer and seller portals, APIs, communications and related services. Access, registration, listing, purchase or continued use after the effective date constitutes acceptance, subject to non-waivable rights.
2. Marketplace Role and Contracting Structure
2.1The Platform connects independent Sellers and Buyers. Unless expressly stated otherwise, the Seller is seller of record, owns or is authorized to sell the product, sets the offer and is responsible for description, quality, authenticity, safety, warranty, invoice and legal compliance.
2.2Bazaar.in may facilitate catalogues, payment collection, logistics, VMS, support, fraud controls and enforcement. Facilitation does not create a partnership, agency, employment or product warranty beyond an express commitment or mandatory law.
3. Eligibility, Registration and Security
3.1Users must be legally competent and provide accurate information. Organizations warrant authority of the accepting representative. Users must protect credentials, use multi-factor authentication where required and promptly report compromise.
3.2Bazaar.in may verify identity, tax, bank, device, address and account information and may link related accounts on documented common-control or evasion evidence. Material action against related accounts is subject to reasoned review where legally possible.
4. Acceptable Use and Prohibited Conduct
4.1Users must comply with law and must not commit fraud, scrape or attack the Platform, bypass controls, impersonate others, manipulate orders or payments, introduce malware, misuse data, interfere with other users or transact in prohibited products.
4.2Off-platform diversion, review manipulation, false claims, counterfeit products, money laundering, sanctions evasion and attempts to compromise VMS or payment controls are material breaches.
5. Listings, Orders and Electronic Records
5.1Listings must contain accurate material information and legally required disclosures. Bazaar.in may standardize, correct, merge, restrict or remove content, but Sellers remain responsible for accuracy.
5.2A Buyer order is an offer. Acknowledgement is not acceptance. The Seller accepts upon dispatch or confirmed pickup readiness unless another event is displayed. Separate items may form separate contracts. Platform logs, OTP events and transaction records are rebuttable business evidence.
6. Payments, Fees and Taxes
6.1Payments may be processed by authorized providers. Bazaar.in does not represent itself as a bank or regulated escrow provider unless the actual licensed arrangement permits that description. Users must comply with provider terms and never disclose PINs or passwords through marketplace messages.
6.2Applicable price, tax, delivery charge and Buyer fee must be shown before confirmation. Seller fees and deductions must appear in an accepted fee card or service schedule.
7. Returns, Refunds and VMS
7.1The Video Management System (VMS) is Bazaar.in's controlled system for capturing, uploading, timestamping, storing, integrity-checking, retrieving and reviewing claim videos and related evidence. VMS may associate video evidence with order, catalogue, payment, delivery, pickup, product, packaging, shipping-label, serial/SKU, seller, account and fraud-risk information.
7.2Except where applicable law requires another remedy, returns will be entertained only when a product is received damaged or an incorrect product is delivered. An incorrect product means the product, model, variant, size, colour, quantity or SKU does not match the confirmed order. Change-of-mind, preference, fit, compatibility, accidental post-delivery damage and no-longer-needed claims are not eligible.
7.3No return is approved until VMS records a decision. VMS must record the evidence considered, outcome, reason, responsible reviewer and timestamp. Bazaar.in may request reasonable evidence, arrange pickup or inspection, and use manual review. The absence of one evidence type, including an unboxing video, will not by itself defeat a remedy required by law.
7.4The Buyer and Seller will receive the decision and a reason for rejection. Either may request grievance review within the stated period. Fraudulent, altered, swapped, unrelated or serial-mismatched returns may be rejected and may lead to account restriction, recovery and lawful reporting.
8. Content, Reviews and Intellectual Property
8.1Users retain ownership of submitted content while granting Bazaar.in a non-exclusive, worldwide, royalty-free licence to host, format, display, moderate and promote it for Platform operations. Illegal, deceptive, abusive, infringing, privacy-violating and manipulated content is prohibited.
8.2Platform software, databases, branding and original content belong to Bazaar.in or its licensors. No licence is granted except as required to use the Platform.
9. Monitoring, Investigation and Enforcement
9.1Bazaar.in may use proportionate monitoring, document requests, test purchases, listing restrictions, payout holds, reserves, suspension or termination to address safety, fraud, counterfeit, data misuse, legal orders or material breach.
9.2Except for urgent safety, fraud or legal risk, material action should include notice, reason, scope, remediation criteria and appeal. Emergency action must be reviewed promptly.
10. Disclaimers, Liability and Indemnity
10.1The Platform is provided on an available basis. To the extent lawful, indirect and consequential loss is excluded and ordinary contractual liability is capped at the affected order amount or fees paid for the affected service, whichever is greater. Nothing excludes fraud, wilful misconduct, personal injury or a non-excludable statutory duty.
10.2Users indemnify the protected Bazaar.in entities for third-party claims caused by their unlawful products, content, fraud, data misuse, tax breach or IP infringement, subject to notice, defence control, cooperation and reasonable settlement consent.
11. Complaints, Governing Law and Changes
11.1Complaints must be handled through published support and grievance channels. Nothing prevents a Buyer from approaching a consumer commission, regulator or mandatory forum.
11.2Indian law governs. Any business arbitration must use a neutral appointment mechanism. Material changes require reasonable notice and do not apply retroactively to completed transactions unless law requires it. Invalid terms are severed; delay is not waiver.
